
UAE Insurance Refuses Payout After Flood: What Are a Car Owner’s Rights?
A UAE resident faced a refusal from their insurance company to compensate for damages after their vehicle was completely submerged in rainwater. Despite holding a valid comprehensive insurance policy and having a police report confirming the incident was beyond their control, the insurer declined to pay, citing the owner’s alleged failure to take “necessary precautions.”
According to UAE law and the terms of standard insurance policies, policyholders are required to take reasonable measures to protect their vehicle. However, whether such precautions were sufficient is a matter for the court to decide. Under Article 1 of the Evidence Law, it is the insurer’s responsibility to prove negligence or intent on the part of the client — the presumption of fault does not apply.
The affected car owner is advised to file an official complaint with the Insurance Disputes Settlement and Resolution Committee. If necessary, legal action can be pursued in court. With supporting documents such as the insurance policy, police report, and proof of good faith, the court may order the insurer to provide compensation in accordance with the policy terms.
